Privacy Policy

FOOPE, INC. (“FOOPE,” “we,” “us,” or “our”) operates the FOOPE brand, foopefragrances.com, and related online services (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit or use the Services, place an order, create an account, subscribe to communications, contact us, or otherwise interact with FOOPE.

1. Personal information we collect

Depending on how you interact with us, we may collect the following categories of personal information.

Information you provide directly

  • Contact information, such as your name, email address, telephone number, billing address, and shipping address.

  • Order and transaction information, such as products purchased, order value, discounts, gift selections, shipping method, returns, refunds, and order history.

  • Account information, such as login credentials, saved addresses, preferences, and account activity.

  • Payment-related information. Payment card and banking information is generally collected and processed by our payment providers. We may receive limited details such as billing address, payment status, transaction identifier, and card type.

  • Customer-service information, including messages, attachments, photographs, reviews, survey responses, and other information you submit to us.

  • Marketing preferences, including email and text-message subscriptions, consent records, and communication preferences.

  • Promotion and referral information, such as referral source, campaign code, giveaway entry, or loyalty activity.

Information collected automatically

When you use the Services, we and our service providers may automatically collect:

  • IP address;

  • browser, device, and operating-system information;

  • approximate location inferred from IP address;

  • pages viewed, links clicked, products viewed, cart activity, and purchase activity;

  • referring and exit pages;

  • cookie, pixel, SDK, advertising, and similar identifiers; and

  • timestamps, error logs, and other technical information.

Information from other sources

We may receive information from Shopify, payment processors, fraud-prevention providers, shipping carriers, marketing and advertising partners, analytics providers, social platforms, and other service providers that help us operate the Services.

2. How we use personal information

We may use personal information to:

  • provide, operate, maintain, and improve the Services;

  • process payments, fulfill orders, arrange shipping, and provide order updates;

  • create and manage customer accounts;

  • provide customer service and resolve delivery, damage, return, or payment issues;

  • personalize products, content, and communications;

  • send transactional messages;

  • send marketing communications where permitted and manage opt-outs;

  • conduct analytics, measure campaign performance, and understand customer behavior;

  • prevent fraud, abuse, security incidents, and unlawful activity;

  • protect FOOPE, our customers, and others;

  • comply with legal, tax, accounting, regulatory, and contractual obligations;

  • establish, exercise, or defend legal claims; and

  • evaluate or complete a merger, financing, sale, restructuring, or other business transaction.

3. How we disclose personal information

We may disclose personal information to the following categories of recipients when reasonably necessary:

  • Commerce and hosting providers, including Shopify and its affiliates.

  • Payment providers that authorize and process transactions.

  • Fulfillment, warehouse, shipping, and delivery providers that prepare and deliver orders.

  • Technology and security providers that host systems, support the website, prevent fraud, and protect accounts.

  • Analytics, advertising, and marketing providers that help us understand performance and communicate with customers.

  • Customer-service and communications providers, including email and text-message platforms.

  • Professional advisers, such as accountants, auditors, insurers, consultants, and legal counsel.

  • Government, regulatory, law-enforcement, or judicial authorities when disclosure is legally required or reasonably necessary to protect rights, safety, and security.

  • Transaction counterparties in connection with a financing, merger, acquisition, bankruptcy, reorganization, or sale of some or all of our business or assets.

We may also disclose information at your direction or with your consent.

4. Shopify

Our online store is hosted by Shopify. Shopify processes personal information to provide commerce, checkout, payment, fraud-prevention, analytics, personalization, and related services. Shopify may act as our service provider in some contexts and may independently determine how information is used in others. Shopify’s own privacy notices apply to its independent processing.

5. Cookies and similar technologies

We and our service providers use cookies, pixels, tags, local storage, and similar technologies to:

  • keep the website functioning;

  • remember settings and cart activity;

  • authenticate accounts;

  • understand traffic and performance;

  • prevent fraud and improve security; and

  • support advertising and marketing.

You can control some cookies through your browser, our cookie or privacy-preference tools, and applicable device settings. Blocking certain cookies may prevent parts of the Services from functioning properly.

6. Advertising, sale, and sharing

FOOPE does not sell personal information for money.

However, some disclosures of identifiers and online activity to advertising or analytics partners may be considered a “sale,” “sharing,” or use for targeted advertising under certain privacy laws. Where required, you may opt out through the privacy-preference tools made available on the website or by contacting us.

Where required and technically supported, we will process recognized universal opt-out signals, such as Global Privacy Control, as an opt-out request.

7. Email and text-message communications

You may unsubscribe from marketing emails by using the unsubscribe link in the message. Even after opting out of marketing, we may continue to send transactional or service communications relating to orders, accounts, security, or policy changes.

If you opt in to text messages, you may receive recurring automated marketing and transactional messages at the number provided. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to unsubscribe and HELP for help. Additional messaging terms and the messaging privacy notice presented at opt-in also apply.

8. Data retention

We retain personal information for as long as reasonably necessary for the purposes described in this Policy, including to:

  • fulfill orders and provide support;

  • maintain business and tax records;

  • resolve disputes;

  • detect fraud and security incidents;

  • enforce agreements; and

  • comply with law.

Retention periods vary by the type of information, our relationship with you, legal requirements, and operational needs. We may retain de-identified or aggregated information that cannot reasonably identify you.

9. Security

We use administrative, technical, and organizational safeguards designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of account credentials and for notifying us promptly if you believe your account or information has been compromised.

10. International processing

FOOPE operates from the United States and uses service providers that may process information in the United States, Canada, and other countries. Those countries may have data-protection laws that differ from the laws where you live.

Where required, we use appropriate contractual or legal mechanisms for cross-border transfers.

11. Your privacy rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • confirm whether we process your personal information;

  • access personal information;

  • correct inaccurate personal information;

  • request deletion;

  • obtain a portable copy;

  • withdraw consent;

  • opt out of targeted advertising, sale, or sharing;

  • object to or restrict certain processing; and

  • appeal a decision relating to a privacy request.

To submit a request, email hello@foopefragrances.com with the subject line Privacy Request. Describe the request and the state or country where you live.

We may need to verify your identity before completing the request. An authorized agent may submit a request where permitted by law, subject to reasonable verification. We will not discriminate against you for exercising a privacy right.

If we deny a request, you may appeal by replying to our decision and stating that you wish to appeal.

12. Legal bases for EEA and UK processing

Where European Economic Area or United Kingdom data-protection law applies, we process personal information under one or more of the following legal bases:

  • performance of a contract;

  • compliance with a legal obligation;

  • our legitimate interests, where those interests are not overridden by your rights; and

  • consent.

You may have the right to lodge a complaint with the data-protection authority where you live.

13. Children

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has submitted personal information to us, contact hello@foopefragrances.com.

A person placing an order must be legally capable of entering into the purchase or have authorization from a parent or legal guardian.

14. Third-party links and services

The Services may link to websites, platforms, or services that FOOPE does not control. Their privacy practices are governed by their own policies. Review those policies before providing personal information.

15. Changes to this Policy

We may update this Privacy Policy from time to time. We will post the revised version with a new effective date. Where required, we will provide additional notice of material changes.
